No year in recent memory rattled the H-1B visa like 2025. It opened with a modernization rule taking effect and a cleaner, cheaper-to-game-proof lottery, and it ended with employers digesting a presidential proclamation attaching a $100,000 payment to many new petitions filed from abroad. If you held or wanted an H-1B, 2025 demanded attention.
The modernization rule took effect
In mid-January 2025, the DHS modernization rule finalized the prior December became operative. It tightened the definition of specialty occupation while adding practical flexibility: codified deference to prior approvals on extensions, a longer cap-gap runway for F-1 students, and clearer rules letting founders be sponsored by companies they partly own. Alongside it, the Form I-129 was updated and the new fee schedule settled in.
A smaller, more honest lottery
The FY2026 registration window in March 2025 was the first with the $215 registration fee, up from $10, and the second under one-person-one-entry selection. Registrations fell to roughly 340,000 to 360,000 eligible entries, down sharply from the speculative peaks of 2023. Fewer junk entries meant materially better odds for applicants with real job offers. Integrity reforms, again, proved pro-immigrant in practice.
Then came September
In late September 2025, the administration issued a proclamation requiring a $100,000 payment tied to certain new H-1B petitions for workers outside the United States. The initial announcement triggered a weekend of confusion, with some companies urging H-1B employees abroad to fly back immediately. Clarifications followed: the measure applied prospectively to new petitions, not to existing visa holders, renewals in most cases, or people already in the country. Lawsuits challenging the proclamation's legality were filed quickly.
Our editorial view: the goal of pushing employers toward higher-value, higher-wage hires is defensible, and so is squeezing out outsourcing models that undercut American and immigrant wages alike. But a six-figure surprise announced on a Friday, effective within days, is policy chaos, and chaos always lands hardest on the people who followed every rule. Durable reform should come through statute and notice-and-comment rulemaking, not shocks.
A weighted lottery on the drawing board
Also in the fall, DHS proposed replacing the random lottery with a wage-weighted selection system that would favor higher-paid, higher-skilled offers. Paired with the proclamation, the direction of travel was unmistakable: fewer, more selective, more expensive H-1Bs.

- If you are already in H-1B status in the U.S., the headline $100,000 measure generally was not aimed at you, but confirm your specific situation before any international travel.
