Behind every immigration headline about the border sits a quieter crisis hitting people who did everything right. By 2021, roughly 8 million cases were pending at U.S. Citizenship and Immigration Services, green card applications, work permits, citizenship files, family petitions, all stacked in a queue that grew faster than it shrank. The USCIS backlog crisis is the clearest indictment of how America treats its legal immigrants: the lawful line got longer while political energy went everywhere else.
How the pile got this high
No single villain built this backlog; a series of compounding failures did:
- A funding model with no cushion: USCIS runs almost entirely on application fees, not tax dollars. When COVID collapsed filing volumes in 2020, revenue cratered, triggering a hiring freeze and a near-furlough of most of its workforce.
- Pandemic operations: field offices closed for months in 2020, canceling interviews and biometrics appointments by the hundreds of thousands, and every canceled appointment became a rescheduled one competing with new filings.
- Policy-driven friction: the prior administration layered on additional interview requirements, tighter scrutiny, and rules later withdrawn, each adding minutes per case across millions of cases.

The human cost of a paper mountain
The consequences are concrete. Work permit renewals ran so late that legal workers lost jobs waiting on a piece of plastic. Citizenship applicants waited a year or more for oaths. Family green card cases idled. And in a detail that should outrage everyone, tens of thousands of employment-based green card numbers were at risk of expiring unused at the fiscal year's end, because the agency could not process fast enough to issue visas Congress had already authorized. Wasting green cards during a backlog is the bureaucratic equivalent of burning food during a famine.
What the agency is doing about it
The new leadership has begun triage: reusing previously captured biometrics instead of requiring new appointments, extending certain document validity periods, expanding online filing, and reinstating deference to prior approvals so routine renewals stop being re-litigated from scratch. Congress is weighing relief for the agency's finances. These are sensible steps, but the arithmetic is stubborn: millions of pending cases against a workforce that was nearly furloughed a year ago means recovery will be measured in years, not months.
What this means for you
You cannot fix the backlog, but you can avoid becoming its easiest victim:
- File renewals at the earliest allowed date, especially work permits, where processing delays can interrupt your right to work.
- Submit clean, complete applications; a Request for Evidence adds months, and most RFEs are triggered by preventable omissions.
- Use online filing where available and keep your address updated; mail returned as undeliverable can quietly kill a case.
- Track your category's posted processing times and use case inquiries or the Ombudsman when your case falls outside them.
- Keep copies of everything and calendar every expiration date, yours and your documents'.
- If premium processing is available for your category, weigh it seriously; in a backlog, certainty has real value.
Legal immigrants are the customers of this system, paying fees that fund the very agency delaying them. They deserve an operation that processes cases with the urgency their lives demand. Until then, the applicants who file early, complete, and error-free are the ones who beat the backlog.
