What is the O-1?

The O-1 is for people who are truly at the top of their field. That could be a scientist, an artist, a business leader, an athlete, or someone in film and TV. The idea is simple: you have risen to the very top and can prove it.

You do not need a specific degree. What matters is your record. Awards, press coverage, high pay, and recognition from others in your field all help build the case.

Para quem é?

It is for standout talent with a job or project in the U.S. A U.S. employer or an agent has to sponsor you. The bar is high, but there is no cap and no lottery, so if you qualify, the door is open.

O que você precisa para se qualificar

  • Strong proof that you are at the top of your field.
  • Evidence such as major awards, press about your work, or high pay.
  • Signs others respect you, like judging contests or leading projects.
  • A U.S. employer or agent to sponsor and the work lined up.

Quanto tempo dura e renovação

The O-1 usually starts with a stay of up to 3 years, tied to your project or job. After that, you can renew in one-year steps for as long as the work continues. There is no strict maximum number of years.

Quanto custa

Costs are typical ranges and vary by case. Government filing fees and attorney fees are separate. Government fees are often a couple of thousand dollars. Attorney fees are charged on top and tend to be higher for the O-1 because the evidence takes real work to prepare.

Como funciona o processo

  1. You gather proof of your achievements and recognition.
  2. A U.S. employer or agent agrees to sponsor you.
  3. You get a written advisory opinion from a peer group when required.
  4. Your sponsor files the O-1 application with your evidence.
  5. If approved, you get the O-1 and can start your work.

Honest key note: the O-1 has no cap and no lottery, which is great. But the standard is high. The whole case rests on strong, well-organized evidence, so quality of proof matters more than anything.

Pode levar a um green card?

Not on its own. But the O-1 pairs well with the EB-1A green card, which is also for people with extraordinary ability. Many O-1 holders use similar evidence to move toward permanent residence over time.

Erros comuns a evitar

  • Thinking a good resume alone is enough. You need real proof.
  • Weak or thin evidence that does not show you are at the top.
  • Not lining up a sponsor or clear U.S. work.
  • Waiting until the last minute to gather awards and press.

Is the O-1 right for you?

If you have a standout record and can back it up, the O-1 gives you flexibility without a lottery. It rewards proof, so the stronger your evidence, the better. If your achievements are still growing, an H-1B or another route may fit better for now.

Nailing your O-1 interview

Here is what the O-1 interview looks like and how to walk in ready.

The O-1 is for people at the top of their field. The officer expects you to speak with confidence about your own achievements, your US employer or agent, and the specific work or events you are coming to do.

  • What is your field, and what are you known for?
  • Who is petitioning for you, and what will you be working on?
  • What are your main awards, credits, or accomplishments?
  • How long is your engagement, and what happens after it?

O que costuma pegar as pessoas: Sounding unsure about your own record, or about who exactly is employing you and for which project.

Perguntas frequentes

Do I need a specific degree?

No. The O-1 is about your record and recognition, not a set degree. Your evidence is what counts.

What kind of proof do I need?

Things like major awards, press coverage, high pay, membership in select groups, and proof that others in your field respect your work.

Is there a lottery or cap?

No. Unlike the H-1B, there is no yearly cap and no lottery for the O-1.

Can my family come with me?

Yes. Your spouse and children under 21 can come on O-3 status, though they cannot work on that status.
