For years the H-1B lottery had a gaping loophole: a single worker could be entered many times by multiple employers, tilting the odds toward those who gamed the system. For the fiscal year 2025 cap season, USCIS closed that loophole with beneficiary-centric selection, a common-sense fix that gave each person one entry no matter how many companies registered them.
The problem with the old system
Under the previous rules, the lottery selected registrations, not people. That meant a worker with, say, five employers submitting registrations had five chances, while a worker with one honest sponsor had one. Predictably, some actors abused this by coordinating multiple registrations for the same individuals.
The results were ugly. The FY2024 cycle drew roughly 780,000 registrations, an implausible spike widely attributed to duplicate and fraudulent filings. Odds for legitimate, single-sponsor applicants cratered, and confidence in the fairness of the lottery collapsed.
How beneficiary-centric selection works
The fix was elegant. Starting with FY2025, USCIS ran the lottery by unique beneficiary rather than by registration:
- Each worker was entered once, identified by passport or travel document, regardless of how many employers registered them;
- Multiple legitimate job offers no longer inflated a person's odds;
- If a person was selected, any of their registering employers could then file the petition;
- The requirement to list a valid passport helped USCIS detect duplicates.
The effect was immediate. Total registrations fell sharply from the FY2024 peak, and the number of unique beneficiaries told a much more honest story. Selection odds for real applicants improved, and the incentive to spam the system with duplicate entries largely disappeared.
Why this was the right call
This is exactly the kind of reform that a pro-legal-immigration, rule-of-law approach should applaud. The H-1B program exists to bring in skilled workers, and its credibility depends on fairness. When cheaters can buy better odds through duplicate registrations, honest employers and workers lose out, and the whole program's legitimacy suffers.
Beneficiary-centric selection did not cut the number of visas or raise the bar for qualifications. It simply made sure the lottery treats each worker equally, which is how a merit-oriented system should behave. USCIS also signaled it would pursue fraud referrals against those who had abused the old process.
What this means for you
If you are an H-1B hopeful or an employer, the new system changes your strategy:
- Multiple registrations no longer help. Being entered by several employers gives you exactly one shot, so focus on genuine offers.
- Have your passport ready. Registration now requires valid passport details, and consistency across filings matters.
- Beware bad-faith arrangements. Schemes to boost your odds through fake or coordinated registrations are now both useless and risky.
- Plan a backup. Odds improved but the cap is still oversubscribed; consider O-1, L-1, or cap-exempt options if the lottery does not select you.
The bottom line: beneficiary-centric selection fixed a broken lottery by rewarding honesty over volume. It made FY2025 fairer for the workers and employers actually playing by the rules, and it set a healthier baseline for the seasons that followed.
